Madrid (Spain), 01 December 2025 (SPS) – The Special Adviser to the President of the Republic in charge of Natural Resources And Related Legal Affairs, Mr. Oubi Buchraya Bashir, affirmed that the Polisario Front, the sole and legitimate representative of the Sahrawi people, will submit a new appeal before the European judiciary before the end of the year. The appeal concerns the latest agreement concluded between Morocco and the European Union, including challenges to trade and fisheries agreements.
Oubi Buchraya Bashir said in press statements, “the Polisario will file a new appeal against this agreement in December before the European courts,” strongly criticizing the controversial classification of Sahrawi products as “Moroccan,” which he described as a clear violation of European judicial rulings.
He reiterated the Polisario Front’s “firm” rejection of all agreements concluded between the two parties concerning Western Sahara, including agricultural and fisheries agreements. He recalled that a majority of European Parliament members rejected legislation related to the “labeling” of products originating from Western Sahara, but the decision was blocked by a margin of only one vote.
The Sahrawi official stressed that the latest agreement between Morocco and the European Union is illegal, noting that the European Court of Justice has confirmed that Western Sahara and Morocco are two separate territories. He pointed out that, since the term “Western Sahara” is unacceptable to the Moroccan occupying authorities, negotiators proposed adopting two new designations related to the occupied regions of Dakhla and El Aaiun — but these labels do not comply with European commercial law, which requires specifying the country of origin.
He further highlighted the absence of the Sahrawi people’s consent regarding this agreement and stated that it is not legally permissible to justify this lack of consent by claiming that local populations would benefit from economic development.
The spokesperson reaffirmed that following the 2024 ruling of the European Court of Justice, there is a strong legal basis to prevent any form of exploitation of Western Sahara’s resources — including agricultural and marine products, energy, tourism, phosphates, and others. He stressed that the Polisario Front will continue using this legal foundation against companies involved in this form of economic colonialism.
He also noted that civil society can play a role in this effort, citing protests held last Wednesday in southern France against the illegal importation of cherry tomatoes.
